If any claim or dispute relating to the goods causes the vehicle to be detained, a charge of ₹2,500 per day per vehicle shall be applicable where such detention is attributable to the Consignor/Consignee.

Any such claim should be raised within 15 days, failing which the claim may be treated as null and void, subject to applicable law.

11. No Responsibility for Delay or Loss Beyond Company’s Control

The Company takes no responsibility for delay, shortage, or loss in transit arising from accidents, strikes, breakdown of vehicles, or any other cause beyond its reasonable control.

12. Delivery Against Receipt

Any shortage attributable to the Company’s handling, where established after investigation, shall be dealt with/recovered in accordance with the Company’s applicable claim procedure and the terms of carriage.

16. Right of Lien / Detention of Goods

The carrier shall have the right to withhold and/or detain the goods at the risk and cost of the Consignor/Consignee until all freight, charges, detention charges, and other amounts due to the Company have been paid.

17. Fire and Insurance

If a loaded vehicle catches fire or goods are destroyed/damaged by fire, the Company shall not be responsible for the loss to the extent the goods were not insured by the Consignor, subject to applicable law and the agreed terms of carriage.

Consignors are advised to obtain appropriate transit insurance for their goods.

18. Liability and Insurance

The Company’s liability for loss or damage shall be subject to the applicable terms of carriage, declared value, agreed liability, and any transit insurance applicable to the consignment.

Claims for uninsured goods shall be limited to ₹50/- only, subject to applicable law.

Where the Consignor has arranged insurance, the Consignor shall be responsible for complying with the requirements of its insurer.

19. Claims Procedure

Any claim relating to delay, shortage, damage, loss, or incomplete documentation must be notified to the Company in writing within 3 days of delivery, or within such other period as may be required by applicable law.

For shortage complaints, the Consignor/Consignee should record the shortage at the time of delivery and obtain the driver’s signature/acknowledgement. Otherwise, the Company may not entertain the complaint, subject to applicable law.

The Consignor shall be solely responsible for all consequences arising from incorrect or false declaration of the contents, nature, quantity, value, weight, or other particulars of the consignment.

21. Necessary Documents

The Consignor shall provide all documents required for safe and lawful transportation of the goods, including, where applicable, invoices, GST documents, e-way bills, permits, customs documents, excise documents, octroi/local authority documents, and other statutory papers.

Any consequences arising at check posts, customs, excise, octroi, or other authorities due to failure to provide proper documents shall be the responsibility of the Consignor.

22. Alteration in Consignment Receipt

Any alteration or amendment to the Consignment Note/Receipt shall not be accepted unless duly authorised and signed by the booking clerk/authorised Company representative with the required initials/signature.

23. Packing Standards

The Consignor/Consignee shall ensure that the goods are packed adequately and securely in accordance with applicable railway, shipping, transportation, and other prescribed packing standards.

The carrier shall not be responsible for damage resulting from insufficient, defective, or improper packing, subject to applicable law.

24. Prohibited, Dangerous and Hazardous Goods

  • the Consignor has informed the carrier before booking;
  • the required declaration has been made;
  • all applicable government permissions have been obtained; and
  • the goods are properly and securely packed according to applicable regulations.

If such goods are booked without proper disclosure or compliance, the carrier may take such action as is reasonably necessary, including refusing, stopping, isolating, destroying, rendering harmless, or otherwise dealing with the goods as required for safety and legal compliance.

The Consignor shall be liable for any loss, damage, destruction, expense, penalty, or liability arising directly or indirectly from the booking or carriage of such goods.

25. Delivery Without G.R.

The Company reserves the right, where applicable, to deliver goods without production of the original G.R./Consignment Note to the party whose name is mentioned in the Consignee column, subject to the Company’s verification and applicable law.

26. Re-booking from Destination

The Company does not undertake any obligation to re-book or arrange onward transportation of goods from the destination unless specifically agreed in writing.

27. Endorsement / Transfer of G.R.

Any person who endorses, transfers, seals, or otherwise assigns the G.R./Consignment Note in favour of any bank or third party shall be responsible for all consequences arising from such action.

28. Open Delivery

Open delivery of packages shall not ordinarily be provided where the Company has not verified or does not have knowledge of the actual contents of the package, particularly where goods were booked on a “said to contain” basis.

Any open delivery shall be subject to applicable law, Company procedure, and the terms agreed at booking.

29. Payment Terms

Freight and other applicable charges shall be payable according to the payment terms agreed at the time of booking or stated in the invoice.

Any delay in payment may result in applicable late-payment, detention, storage, or other charges.

A dispute or claim concerning a consignment shall not automatically suspend payment of undisputed freight or other charges.

30. Cancellation

Cancellation of a confirmed booking may be subject to cancellation charges depending upon the stage of booking, vehicle placement, dispatch, and other costs already incurred by the Company.

Where the vehicle has already been dispatched or committed, the Consignor may be liable for applicable cancellation, detention, or other costs.
